The National Commission for the Forensic Use of DNA (CNUFADN) as a Tool for Coordination and Standardization Between Spanish Forensic Genetics Laboratories

In 2003, in order to provide legal coverage (which lacked until then), certain investigative practices were carried out in Spain to reform the Law on Criminal Prosecution. This reform established the creation of the National Commission for the Forensic Use of DNA (CNUFADN) whose functions and composition are articulated in Royal Decree 1977/2008.

The CNUFADN constitutes an essential element for the coordination and promotion of genetic analysis for human identification purposes in Spain. Among the functions attributed by law are those related to accreditation, coordination, the elaboration of official protocols and the determination of the security conditions of the laboratories empowered to contrast genetic profiles.

 

 

Since its inception in 2008, CNUFADN’s activity has been diverse and fruitful thanks to the dynamic momentum and close coordination of the two working groups that comprise it, the permanent technical mission and the bioethical and legal group.

Numerous guides and recommendations have been developed, and technical standards have been established for use in laboratories in our country. Among others, recommendations for the analysis of mixed profiles, issuance of opinions, use of new genetic markers, development of unified population databases throughout the country, and a guide on the use of DNA for judicial groups.

In his presentation during the GCLAITH meeting at ISHI 31, Manuel Crespillo Marquez shared how the CNUFADN has been a tool of undoubted use in the technical and scientific advancement of genetic analysis for the purposes of human identification and effectively contributes to providing credibility and rigor to genetic  testing before the Courts of Justice.

As there was not enough time to answer all of the questions that came in during his presentation, we’ve compiled them here.

 

What happens if a laboratory fails to successfully pass external quality control?

When a laboratory disagrees in the results agreed by the organizer of an external exercise, the laboratory must evaluate the reason for these discrepancies. As we know, these can be diverse (transcription, nomenclature, due to contamination, resolution of the equipment … ). We also know that not all mistakes have the same impact. The evaluation carried out by the laboratory is also sent to the Commission, which, based on this evaluation, makes a decision in this regard. Fortunately, so far, there are very few situations in which errors in external controls have disabled a laboratory. If the internal evaluation carried out by the laboratory is not satisfactory, the Commission issues the laboratory a recommendation for improvement with respect to the error detected and requests records to ensure that the laboratory will correct the type of error detected.

 

Once the laboratories are approved by the commission, they are empowered to enter genetic profiles to the Genetic Profiles Bank. Who directs that Bank and is there some regulation from a technical point of view for the operation of the bank? Where can we consult about that regulation?

Regarding the first part of the question, the answer is yes, as long as the Spanish database law (ORGANIC LAW 10/2007, of October 8, regulating the police database on identifiers obtained from the DNA) establishes that only laboratories accredited for this purpose by the National Commission for the forensic use of DNA that pass the periodic quality controls to which they must undergo may perform DNA analysis for genetic identification in the cases contemplated in this Law.

Regarding the “address of the database”, the same law says that the police database of identifiers obtained from DNA will depend on the Ministry of the Interior, through the Secretary of State for Security.

Does the guide have only Spanish legislation?

I don’t quite understand the question but I think it refers to whether the legislation is applicable exclusively to Spanish territory, if this is the intention of the question, the answer is yes, it is exclusively Spanish legislation

 

Have the biogeographic and phenotype analyzes been considered as a contribution or proof of legal weight in the Spanish courts?

In this sense, the Law provides the following:

The preamble states that this regulation contains a very special safeguard, which is essential to eliminate any violation of the right to privacy, since only those DNA profiles that are exclusively revealing of the identity of the subject may be registered. That offers a fingerprint- and sex, but, in no case, those of a coding nature that allow to reveal any other data or genetic characteristic and in article 4 of the Law. They may only be registered in the police database regulated in this Law the identifiers obtained from DNA, in the framework of a criminal investigation, that exclusively provide genetic information revealing the identity of the person and their sex.

 

Therefore, at present, the legislation on the matter in Spain does not contemplate it, and therefore the biogeographic and phenotype analysis is not provided regularly before the Spanish Courts of justice, although it is true that in some very specific situation and upon request judicial express this tool has been used to help in the police investigation.

 

Recently (2020) the CNUFADN issued some recommendations in this regard that can be consulted here.

 

Do you have any policy in Spain for the processing of samples that were initially entered into the Genetic Profiles Bank with fewer markers than those currently being processed?

There are genetic profiles in the Spanish DNA database with the battery of markers from “old” kits that included fewer markers, although it is true that in the event of an eventual match, and before assuming the coincidence, the laboratories have the possibility of being able to rescue the DNA extract that generated that initial profile and reamplify it with latest generation kits. It is also true that this extract may not always be able to be reamplified for different reasons.

 

In additional to autosomal profiles, does the DNA Database of Spain incorporate haplotype markers? As Y Chromosome haplotype, or Mitochondrial DNA?

Spain uses the CODIS software as a DNA database management tool, and in this sense CODIS mainly uses autosomal STR technology, however, other technologies that CODIS accepts (Y chromosome STR and Mitochondrial DNA, as a helper and confirmation tool in certain situations (identification of cadavers) Although currently, routine database searches are done with autosomal STR markers, in fact, many laboratories include Y chromosome profiles of their samples in the DNA database.

En el año 2003, y con el fin de proporcionar cobertura jurídica, de la que carecían hasta entonces, a determinadas prácticas de investigación se llevo a cabo en España una reforma de la Ley de Enjuiciamiento Criminal. Se establece en dicha reforma la creación de la Comisión Nacional para el uso forense del ADN (CNUFADN) cuyas funciones y composición quedan articuladas en el Real Decreto 1977/2008, de 28 de noviembre. La CNUFADN constituye un elemento esencial para la coordinación y el impulso del análisis genético con fines de identificación humana en España. Entre las funciones que le atribuye la ley se encuentran las relacionadas con la acreditación, la coordinación, la elaboración de protocolos oficiales y la determinación de la condiciones de seguridad de los laboratorios facultados para contrastar perfiles genéticos. Desde su creación en 2008, la actividad de la CNUFADN ha sido diversa y fructífera gracias al impulso dinámico y la estrecha coordinación de los dos grupos de trabajo que la componen, la comisión técnica permanente y la grupo bioético y jurídico. Se han elaborado numerosas guías y recomendaciones,  y se han establecido estándares técnicos para su uso en los laboratorios de nuestro país. Entre otras, recomendaciones para el análisis de perfiles mezcla, emisión de dictámenes, empleo de nuevos marcadores genéticos, desarrollo de bases de datos poblacionales unificadas para todo el país, guía sobre uso de ADN para colectivos del ámbito judicial…. Con la perspectiva del tiempo, hoy podemos decir que la CNUFADN ha supuesto una herramienta de indudable utilidad en el avance técnico y científico del análisis genético con fines de identificación humana y contribuye de manera eficaz a dotar de credibilidad y rigor a la prueba genética ante los Tribunales de Justicia.

 

Que sucede si un laboratorio no logra pasar de manera satisfactoria el control de calidad externo? 

Cuando un laboratorio discrepa en los resultados consensuados por el organizador de un ejercicio externo, el laboratorio debe evaluar el motivo de esas discrepancias, como sabemos, éstas pueden ser diversas (transcripción, nomenclatura, debido a contaminaciones, de resolución de los equipos…). También sabemos que no todos los errores tienen el mismo impacto ni la misma repercusión. La evaluación llevada a cabo por el laboratorio también es remitida a la Comisión, la cual, en base a esa valoración toma una decisión al respecto. Afortunadamente, hasta el momento, son muy escasas la situaciones en las que los errores en controles externos han inhabilitado a un laboratorio. Si la evaluación interna llevada a cabo por el laboratorio no fuera satisfactoria, la Comisión emite al laboratorio una recomendación de mejora respecto al error detectado y solicita registros que costante como el laboratorio subsanara el tipo de error detectado.

 

Una vez los laboratorios son aprobados por la comisión, quedan facultados para ingresar perfiles genéticos al Banco de Perfiles Genéticos, quién dirige ese Banco y existe alguna regulación desde el punto de vista técnico para el funcionamiento del banco y dónde podemos consultar sobre esa regulación?

Respecto a la primera parte de la pregunta la respuesta es que si, en tanto en cuanto la ley de base de datos española (LEY ORGÁNICA 10/2007, de 8 de octubre, reguladora de la base de datos policial sobre identificadores obtenidos a partir del ADN ) establece que Sólo podrán realizar análisis del ADN para identificación genética en los casos contemplados en esta Ley los laboratorios acreditados a tal fin por la Comisión Nacional para el uso forense del ADN que superen los controles periódicos de calidad a que deban someterse.

Respecto a la “dirección de la base de datos” , esa misma ley dice que La base de datos policial de identificadores obtenidos a partir del ADN dependerá del Ministerio del Interior, a través de la Secretaría de Estado de Seguridad.

Para el doctor Crespillo; la guía tiene legislación únicamente española?

No acabo de entender bien la pregunta pero creo que se refiere a si la legislación es aplicable exclusivamente al territorio español, si es esta la intención de la pregunta, la respuesta es que sí, es legislación exclusivamente española

 

Dr Crespillo, los análisis biogeograficos y de fenotipo han sido considerados como aporte o prueba de peso legal en las cortes españolas?

En este sentido la Ley prevee lo siguiente:

 

En el preámbulo  recoge que Esta regulación contiene una salvaguarda muy especial, que resulta fundamental para eliminar toda vulneración del derecho a la intimidad, puesto que sólo podrán ser inscritos aquellos perfiles de ADN que sean reveladores, exclusivamente, de la identidad del sujeto -la misma que ofrece una huella dactilar- y del sexo, pero, en ningún caso, los de naturaleza codificante que permitan revelar cualquier otro dato o característica genética y en el art 4 de la Ley Sólo podrán inscribirse en la base de datos policial regulada en esta Ley los identificadores obtenidos a partir del ADN, en el marco de una investigación criminal, que proporcionen, exclusivamente, información genética reveladora de la identidad dela persona y de su sexo.

 

Por tanto, en la actualidad la legislación al respecto en España no lo contempla, y por tanto el análisis biogeograficos y de fenotipo no es aportado de manera regular ante los Tribunales de justicia españoles, si bien es cierto que en alguna situación muy concreta y a requerimiento expreso judicial esta herramienta ha sido empleada para ayudar en la investigación policial.

Tienen alguna política en España para el procesamiento de muestras que fueron ingresadas inicialmente al Banco de Perfiles Genéticos con menos marcadores que los que actualmente se trabajan?

Si existen en la base de datos de ADN española perfiles genéticos con la bateria de marcadores de kits “antiguos” y que incluian menos marcadores, si bien es cierto que ante un eventual match, y antes de dar por cierta la coincidencia, los laboratorios tienen la posibilidad de poder rescatar el extracto de ADN que generó ese perfil  inicial y reamplificarlo con kits de última genearción. También es cierto que no siempre ese extracto puede estar en condicionesde ser reamplificado por distintas razones.

 

Dr. Crespillo, la Base de Datos de ADN de España, además de perfiles autosómicos ¿incorpora marcadores haplotípicos? ¿como haplotipo de Cromosoma Y, o ADN Mitocondrial?

España emplea el software CODIS como herramienta de gestión de la base de datos de ADN, y en este sentido CODIS emplea de manera principal la tecnología de STR autosómicos, no obstante, también se pueden usar otras tecnologías que acepta CODIS (STR del cromosoma Y y ADN mitocondrial, como herramientas de ayuda y confirmación  en determinadas situaciones (identificación de cadáveres)  Aunque actualmente, las búsquedas rutinarias en la base de datos se hacen con marcadores de STR autosómicos.De hecho, muchos laboratorios incluyen perfiles de cromosoma Y de sus muestras en la base de datos de ADN.
