When ‘Unsuitable’ Obscures ‘Absent’: A Case-Based Analysis of DNA Reporting Pracitices

Background: Forensic DNA evidence is widely regarded as the gold standard in criminal investigations, particularly in sexual assault cases. However, misinterpretation or misreporting of DNA results can contribute to a misunderstanding of evidentiary value and impact case outcomes. This presentation examines two criminal sexual conduct cases in which laboratory reporting practices obscured potentially exculpatory findings.

Methods: Case file review, laboratory reports, and underlying analytical data were examined in two separate prosecutions involving allegations of sexual penetration. In both cases, sexual assault kits were collected and subjected to differential extraction and Y-chromosome quantification (Y-quant) analysis targeting sperm cell and non-sperm fractions from anatomical locations identified by the complainants. Reported findings were compared to the underlying bench data, laboratory reporting language, and standard reporting guidelines.

Results: In both cases, Y-quant testing demonstrated an absence of detectable male DNA in both sperm cell and non-sperm fractions from all tested samples associated with the alleged sexual activity in dispute. Despite these findings, the forensic laboratory did not report the results as “no male DNA detected.” Instead, reports characterized the samples as “not suitable for DNA testing.” This language masked the potential exculpatory nature of the results and influenced how the findings were interpreted and presented in court. In each case, the reporting language became a critical issue for trial, influencing how the evidence was perceived.

Conclusion: These cases illustrate how reporting practices — independent of the underlying science — can materially affect case outcomes. The distinction between “no male DNA detected” and “unsuitable for testing” has significant implications for forensic interpretation and highlights the need for consistency between analytical findings and reporting language, particularly in cases involving negative DNA results.
